Terms of Service

Last updated: September 10, 2026

These Terms explain the rules for using Talking Ancestors, including the Talking Obituary service and Talking Ancestor Library.

Important: This is a plain-language draft for the current Talking Ancestors product. It should be reviewed by qualified counsel for the jurisdictions where the service is offered before it is treated as final legal advice.

1. Acceptance

By creating an account, accessing, or using Talking Ancestors, you agree to these Terms and our Privacy Policy. If you use the service on behalf of a funeral home, family, or other organization, you confirm that you are authorized to accept these Terms for that organization.

2. Eligibility and accounts

You must provide accurate information, keep your login credentials secure, and promptly notify us of unauthorized access. You are responsible for activity under your account. You may not use the service if you are prohibited from doing so by applicable law or if your account has been suspended or terminated.

3. The service

Talking Ancestors provides tools to preserve stories and create requested digital experiences, which may include Talking Obituaries, ancestor profiles, AI-generated conversations, audio, video, and images. Features may change, become unavailable, or require additional terms or fees. We do not guarantee that any generated output will be available forever or be error-free.

4. Your content and permissions

You retain ownership of content you submit. You grant Talking Ancestors a limited, worldwide, non-exclusive license to host, reproduce, modify as technically necessary, transmit, and process your content solely to provide, secure, support, and improve the service you request.

You represent that you have the rights, permissions, and authority needed to submit the content and grant this license. This includes permission for photographs, voice recordings, biographies, genealogy data, and information about other living people. You are responsible for obtaining any consent required to create or share an experience involving another person.

5. AI-generated experiences

AI-generated text, audio, video, images, and conversations are simulations or creative outputs. They are not statements made by a deceased person, historical proof, medical or legal advice, or a substitute for professional support. Generated output can be inaccurate, incomplete, or inappropriate. Review it before sharing, and do not rely on it for decisions requiring factual or professional certainty.

Do not use Talking Ancestors to impersonate a living person, mislead others about the origin of content, create fraudulent evidence, or cause harm.

6. Acceptable use

You may not:

7. Family and organization access

Users may invite others to contribute to or view a case or ancestor profile. The person who grants access is responsible for choosing appropriate collaborators and removing access when it is no longer appropriate. Access can expose shared stories, photos, recordings, and profile information to invited users.

8. Fees and third-party services

If paid features are introduced, their prices, renewal terms, taxes, and cancellation rules will be presented before purchase. Talking Ancestors may depend on third-party hosting, storage, authentication, media, analytics, AI, or communication services. Those services may have their own terms, limitations, and privacy practices.

9. Intellectual property

Talking Ancestors and its software, design, branding, and documentation are owned by Talking Ancestors or its licensors. Except for the limited right to use the service under these Terms, no rights are transferred to you. You may not copy, modify, reverse engineer, or create derivative works from the service except where applicable law permits.

10. Suspension and termination

You may stop using the service at any time. We may suspend or terminate access if you violate these Terms, create risk, fail to pay applicable fees, or if we discontinue the service. We may preserve or delete content according to our Privacy Policy, legal obligations, and operational needs.

11. Disclaimers

To the extent allowed by law, Talking Ancestors is provided “as is” and “as available.” We disclaim warranties of uninterrupted availability, accuracy, fitness for a particular purpose, non-infringement, and any guarantee that generated output will meet your expectations. We are not responsible for decisions made based on generated content or for content supplied by users.

12. Limitation of liability

To the extent allowed by law, Talking Ancestors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, revenue, profits, or goodwill arising from or related to the service. Our total liability for claims related to the service will not exceed the amount you paid us for the service during the twelve months before the event giving rise to the claim, or $100 if you paid nothing. Some jurisdictions do not allow these limitations, so some may not apply to you.

13. Indemnity

To the extent allowed by law, you agree to defend, indemnify, and hold harmless Talking Ancestors and its service providers from claims, losses, liabilities, and expenses arising from your content, your use of the service, your violation of these Terms, or your violation of another person’s rights.

14. Changes and governing law

We may update these Terms as the service changes. We will post the updated version and change the date above. Continued use after an update means you accept the revised Terms. Any governing-law, venue, dispute-resolution, or consumer-rights provisions should be completed with jurisdiction-specific legal review before launch.
